The court's unsigned order upholds a lower court ruling that refused to include Kennedy's name ahead of the November 5 election. His initial request was submitted to Justice Sonia Sotomayor and later referred to the full court, which issued its decision without any noted dissents.
Kennedy's legal representatives argued that the residency requirement cited by New York officials was not pertinent to the presidential election process and claimed that enforcing this rule infringed upon his First Amendment and 14th Amendment rights. However, the Supreme Court's decision concludes his attempts to remain on the ballot in New York.
This case marks the third election-related matter to be addressed by the Supreme Court in relation to the 2024 presidential election. Previously, the court allowed part of an Arizona voter registration law to proceed while blocking certain provisions requiring proof of citizenship for voting in presidential elections and by mail. Additionally, the court recently rejected a request to place Green Party candidate Jill Stein on the ballot in Nevada.
