Special counsel Jack Smith has provided additional details on former President Donald Trump's alleged efforts to overturn the 2020 presidential election in a 165-page court filing. The document, unsealed by U.S. District Judge Tanya Chutkan, offers insights into a strategy to counter Trump’s claims of election fraud and contest the Supreme Court's ruling on presidential immunity.
The filing alleges that a Trump campaign employee attempted to disrupt the vote-counting process at Detroit’s TCF Center, a key ballot-processing site in Michigan. This effort, prosecutors claim, was part of a larger plan to incite unrest and challenge the certification of election results in multiple states. The document further accuses Trump and his co-conspirators of pressuring state officials in battleground states like Michigan, Georgia, and Pennsylvania, using unfounded claims of voter fraud to alter the outcome.
The filing states that Trump, acting as a candidate rather than a president, pursued fraudulent means to disrupt the vote-counting process. This argument seeks to undermine a Supreme Court decision from July that suggested former presidents have limited immunity from prosecution.
Prosecutors are now requesting that the court rule Trump is not immune from prosecution and that the case proceeds to trial.
