A federal judge has set the trial date for the wrongful death lawsuit filed by Ashli Babbitt's family for July 20, 2026. Babbitt was fatally shot by law enforcement during the January 6, 2021, Capitol riot. Her family is seeking $30 million from the United States government, alleging negligence on the part of U.S. Capitol Police Lt. Michael Byrd, who shot Babbitt as she attempted to breach the House Speaker's lobby.
The trial date was initially targeted for 2025, but both sides indicated that additional time was necessary for proper preparation. Although they requested a trial start in 2027, U.S. District Judge Ana Reyes deemed that timeline unacceptable, directing them to propose a date no later than December 2025.
During a recent hearing, both parties agreed that discovery for the case would take approximately eight months. However, there were concerns about potential disputes regarding the scope of discovery. The government cautioned that the plaintiff's attorneys might attempt to expand the case into a broader investigation of the events of January 6. Conversely, Babbitt's lawyers expressed concerns that the government might seek to limit its liability by withholding certain information.
Judge Reyes emphasized the need for cooperation, stating that disputes should not escalate to her court unless absolutely necessary. The case continues to draw attention as it approaches its trial date in 2026.
