A federal judge has set a trial date for the wrongful death lawsuit filed by the family of Ashli Babbitt, who died after being shot by U.S. Capitol Police Officer Michael Byrd during the January 6 Capitol riot. The lawsuit, which seeks $30 million, is being assisted by the watchdog group Judicial Watch. Judge Ana C. Reyes of the U.S. District Court for the District of Columbia has scheduled the trial for July 20, 2026.
Following a hearing on the case, Judicial Watch announced that the judge is also considering a request to move the trial to California, where Babbitt's family resides. Tom Fitton, President of Judicial Watch, stated that Babbitt's family is relieved the case is progressing and is seeking accountability for her death.
On January 6, 2021, Babbitt was among the protesters attempting to enter the Speaker's Lobby. During this event, she was shot by Officer Byrd, who has since faced no punishment for his actions. The lawsuit alleges that Babbitt was unarmed and had her hands raised as she entered the hallway. It also claims Byrd did not identify himself or give any warnings prior to the shooting.
Babbitt traveled from San Diego to Washington, D.C., to attend the “Women for America First” rally featuring then-President Donald Trump. Judicial Watch has previously released a video of the incident that supports the claims made in the lawsuit.
