California has implemented Assembly Bill 1955, a law that prohibits schools from notifying parents if their child identifies as transgender or changes their gender identity without the student’s consent. Signed by Governor Gavin Newsom in July 2024, the legislation, known as the Support Academic Futures and Educators for Today’s Youth Act (SAFETY Act), aims to protect the privacy of LGBTQ+ students throughout the state.
The law was introduced by Assemblyman Chris Ward and is intended to safeguard the well-being of LGBTQ+ youth by ensuring that discussions about gender identity remain confidential unless the student chooses to share the information. School staff are not required to disclose a student’s gender identity or expression to parents or guardians unless state or federal law mandates otherwise.
While proponents of the law emphasize the importance of student privacy and safety, opponents have raised concerns about its impact on parental rights. Critics, including Assemblyman Bill Essayli, argue that withholding such information from parents could prevent them from being involved in important aspects of their child's health and well-being. Some school districts, like Chino Valley Unified School District, had previously implemented policies that required parental notification, which are now nullified under the new law.
California Attorney General Rob Bonta previously informed school boards that policies forcing disclosure of a student's gender identity could violate constitutional rights to privacy and equal protection. The SAFETY Act aligns with this stance by preventing schools from adopting notification policies that specifically target transgender or gender non-conforming students.
The passage of the SAFETY Act has drawn national attention. Elon Musk, CEO of SpaceX and X (formerly Twitter), cited the new law as one of the reasons for relocating his companies from California to Texas, describing the state’s progressive policies as a factor in his decision.
Legal challenges have followed the enactment of the SAFETY Act. The Liberty Justice Center, representing Chino Valley Unified School District and several parents, has filed a lawsuit claiming that the law infringes upon parental rights and conflicts with both state and federal regulations.
While California is the first state to pass such legislation, other regions have faced similar legal debates. A federal court in Wisconsin previously ruled that a school district’s policy of affirming a student’s gender identity without notifying parents violated the parents’ constitutional rights.
